Article 1: Scope of Application

These general terms and conditions of sale (hereinafter the “GTC”) apply between:
– on the one hand, the Customer, an adult individual or legal entity with the legal capacity to enter into a contract and acting either in a non-professional capacity for non-professional needs, or in a professional capacity and/or for professional needs;
– and on the other hand, https://www.musique-medievale.fr/ (hereinafter the “Seller”).
The GTC apply to all orders placed between the Customer and the Seller via the Website.
The Customer may, at any time, record, save or print the GTC.
The Seller reserves the right to modify the GTC at any time. In the event of a modification, the GTC in force on the date the order is placed shall apply to each order.

Article 2: Acceptance of the GTC

The Customer expressly declares that they have read all of the Seller’s GTC before confirming their order.
By confirming their order on the Website, the Customer attests and certifies that they have the capacity to enter into a contract and acknowledges having accepted, without reservation, the GTC applicable to their order.

Article 3: Price
.
The price stated on the Website is indicated in euros, inclusive of all French taxes (including value-added tax at 5.5%, at the rate in force for digital books). Prices may be changed at any time. However, the prices applied to an order shall be those announced on the date the order is placed. Any change in the VAT rate or creation/modification of an applicable tax shall be reflected immediately in the prices.
The Customer’s attention is drawn to the fact that the prices displayed on the Website are prices inclusive of all taxes for mainland France. If the Customer does not reside in mainland France at the time of the order, different and/or additional taxes may be applied to their order automatically during the payment process. The Customer is therefore invited to carefully read the total amount of the order as announced on the secure payment site before confirming their payment.

Article 4: Payment

Payment is due immediately on the date of the order. You may pay by bank card or PayPal.
The information transmitted is encrypted using state-of-the-art software and cannot be read while being transported over the network. Any guarantee regarding the security of this system is entirely the responsibility of the bank and cannot be attributed to us.
Payment by check or bank transfer is not possible.

Article 5: Delivery

The digital book is sent directly to the email address you provided when placing your order. The Customer is invited to carefully check the accuracy of the email address provided to the Seller when placing the order. The Seller cannot be held liable in the event of an error by the Customer in communicating their email address. Therefore, please pay particular attention to the spelling of the address you enter.

Article 6: Withdrawal
.
In accordance with the provisions of Article L121-20 of the French Consumer Code, the
Customer benefits from a right to withdraw from their order.
The Customer has a period of seven clear days from acceptance of the service offer to exercise their right of withdrawal without having to provide reasons or pay penalties. When the seven-day period expires on a Saturday, Sunday, public holiday or non-working day, it is extended until the next working day.

Article 7: Commercial Warranty
.
The Customer’s attention is drawn to the fact that the commercial warranty is in addition to the applicable statutory warranty and the right of withdrawal. The benefit of the commercial warranty does not exclude the application of the statutory warranty and the right of withdrawal, and does not modify limitation periods or limitation rules.
The digital book “Learn to Read Music in 30 Days” comes with a satisfaction guarantee. If the Customer is not satisfied with the book, they have 30 calendar days from receipt of their order to request a refund.
The Customer submits their refund request using the contact form.
The Customer must provide their first and last name, the email address supplied during registration, and any other information required for the refund process.
Where applicable, the Customer is refunded to the PayPal account or the bank account linked to the bank card used for the order, or by bank transfer, within a maximum period of 7 days.

Article 8: Protection of Personal Data

The personal data provided by the Customer is intended for the Seller. The Seller undertakes to respect the confidentiality of this personal data and to process it in compliance with the provisions of French Law No. 78-17 of January 6, 1978 relating to information technology, files and civil liberties (the “Data Protection Act”) in its currently applicable version.
The Seller will use this data to process the Customer’s order, as well as to send information relating to the training, commercial or non-commercial information, and for statistical purposes.
In accordance with the amended French Data Protection Act of January 6, 1978, the Customer has the right to access, modify, delete and rectify personal data concerning them and retained by the Seller. The Customer may exercise the aforementioned rights by submitting their request (indicating their email address, last name, first name and postal address) via the contact form.

Article 9: Information Provided by the Customer

The Customer is solely responsible for the information they have provided to the Seller pursuant to the GTC.
Consequently, the Seller cannot be held liable for the consequences of any error related to the transmission of incorrect or incomplete information.

Article 10: Applicable Law and Disputes
.
In the event of a dispute, an amicable solution shall be sought before any legal proceedings.
The prior search for an amicable solution does not interrupt the time limits for taking action under warranty, particularly against the Seller.
All disputes relating to the use of the Website, the placing of orders, the obligations of the parties, the training, the interpretation, performance or non-performance of a contract between the Seller and the Customer pursuant to the GTC shall be subject to the exclusive jurisdiction of the courts within the jurisdiction of the Dijon High Court, including in summary proceedings and notwithstanding any third-party claims.
These GTC and the resulting contracts are governed by French law.
